The rules and agreements that govern your use of MerchReel.

These Terms of Service ("Terms") are a legal agreement between you ("Merchant" or "you") and the operator of MerchReel ("MerchReel", "we", or "us") governing your use of the MerchReel Shopify application hosted at merchreel.chriscastle.com. By installing or using MerchReel, you agree to these Terms. If you do not agree, do not install or use the app.
MerchReel is a Shopify application that generates AI-powered promotional videos from your product catalog. The service includes:
You must have an active Shopify store and be authorized to install apps on that store. By agreeing to these Terms, you represent that you have the legal authority to bind your business to this agreement.
MerchReel authenticates via Shopify OAuth. You are responsible for maintaining the security of your Shopify account. We are not liable for any unauthorized access to your MerchReel data resulting from a compromised Shopify account.
MerchReel offers three monthly subscription tiers — Starter ($19/mo), Growth ($49/mo), and Pro ($99/mo) — with differing video generation limits. Current pricing is always available at merchreel.chriscastle.com/#pricing.
All charges are processed through the Shopify Billing API and appear on your existing Shopify invoice. We do not collect payment information directly. Shopify's billing terms govern the payment relationship.
Each plan includes a monthly video generation limit. Limits reset at the start of each billing cycle. Renders that fail due to a service error on our end do not count against your limit.
You may cancel your MerchReel subscription at any time by uninstalling the app from your Shopify admin. Cancellation takes effect at the end of your current billing period. We do not issue prorated refunds for partial months.
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the next billing cycle.

We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.
You retain full ownership of your product data, images, and brand assets. You grant MerchReel a limited license to process this content solely for the purpose of generating videos you have requested.
Videos generated using your product data are yours to use for marketing, social media, and on-site purposes. We claim no ownership over the output videos. You are responsible for ensuring that your use of the generated videos complies with applicable law and platform terms.
Scripts are generated by OpenAI's GPT-4o. Avatar visuals are rendered by HeyGen. You acknowledge that AI-generated content may occasionally contain errors, and you are responsible for reviewing output before publishing.
The MerchReel application, branding, and underlying technology are our intellectual property. These Terms do not grant you any rights to our trademarks, service marks, or proprietary technology.
We strive to keep MerchReel available at all times but cannot guarantee uninterrupted service. Video generation depends on third-party services (OpenAI, HeyGen) and may be subject to their outages or rate limits. We will not issue refunds for downtime caused by third-party service providers.
MerchReel is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, that generated videos will meet any specific quality standard, or that output will be suitable for any particular marketing purpose.
To the maximum extent permitted by law, MerchReel's total liability to you for any claims arising out of these Terms or the use of the service shall not exceed the total fees you paid to us in the three months immediately preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
You agree to indemnify and hold MerchReel harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your product content, or your violation of these Terms.
Either party may terminate this agreement at any time. We may terminate or suspend your access immediately if you breach these Terms. Upon termination, your right to use MerchReel ceases and we will begin deletion of your data as described in our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of MerchReel after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Tennessee.
